5 Opposition Parties to challenge Pawan Chamling ‘Kiran’s copyright violation case filed against them
GANGTOK: The Opposition parties in the State has decided to challenge a case filed against them for alleged copyright violation by Pawan Chamling ‘Kiran,’ who also happens to be the Chief Minister of the State.
Five Opposition parties of the State led by former Chief Minister and Sikkim Pradesh Congress Committee president, have “unanimously decided to jointly contest the case” filed Mr. Chamling, for publishing one of his poems titled ‘Satta’ in a propaganda publication.
The five Opposition parties of the State, which includes Sikkim State BJP, State CPI (M), Sikkim Himali Rajya Parishad and Sikkim Gorkha Prajatantrik Party, said in press release issued today that they had decided to challenge the case filed by Mr. Chamling. Since the matter is now sub-judicial, they have refrained from making any further comments on this matter.
The press release has been signed by Mr. Bhandari, HR Pradhan, President, BJP, PP Koirala, CPI(M), AD Subba, SHRP and GM Rai, SGPP.
It may be recalled here that last month in May, Mr. Chamling had filed a case against Mr. Bhandari and 13 others in the Courts for alleged violation of copyright laws for reproducing his poem without his permission. The petition had been filed in the name of Pawan Chamling ‘Kiran,’ the poet and not as the Chief Minister. It was filed on May 17 2007 at the Court of the Chief Judicial Magistrate, Gangtok and the Court had taken cognizance of the case under Section 63 of the Copyright Act, 1957 along with Section 34 of the IPC.
Mr. Chamling had taken exception to the fact that the poem “Satta”from his collection of poetry entitled ‘Antaheen Sapana: Mero Sipana’ had been reproduced by the Opposition parties in the joint publication entitled ‘SDF Party’s ko Chunau Ghosna- Pach Bipakshi Dalko Prasna,’ which contained allegations made by them against the ruling SDF party that was distributed by them to the public at Rangpo in May itself. The poem was reproduced without the permission of the poet.
